1. Acceptance of Terms

By accessing or using the Hema platform (the "Service"), operated by [HEMA LLC] ("Hema," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We reserve the right to modify these Terms at any time. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

2. Description of Service

Hema is an informational health technology platform that allows users to:

• Enter blood test biomarker values
• Receive AI-generated interpretations of those results
• Generate personalized 12-week health protocols
• Track health metrics over time via a personal dashboard

The Service is for informational and educational purposes only. It is not medical advice. See Section 6 for important limitations.

3. Eligibility

To use the Service, you must:

• Be at least 18 years of age
• Be a United States resident, or acknowledge that United States law governs your use of the Service
• Have the legal capacity to enter into a binding agreement

4. Account Registration

To access certain features of the Service, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

5. Subscription & Payments

Pricing Options

• Single Report: A one-time purchase that includes one blood test interpretation and one personalized 12-week protocol.
• Hema Pro: A recurring monthly subscription at $14.99/month that provides unlimited interpretations, protocol generation, and dashboard access.

Billing

All payments are processed securely through Stripe. By subscribing to Hema Pro, you authorize us to charge your payment method on a recurring monthly basis until you cancel.

Cancellation

You may cancel your Hema Pro subscription at any time through your account settings. Upon cancellation, you will retain access to the Service until the end of your current billing period.

Refunds

Refunds are provided at Hema's sole discretion, generally limited to cases of documented technical failures that prevent delivery of the Service. Contact support@hema.health for refund inquiries.

6. IMPORTANT — Not Medical Advice

THE SERVICE IS FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY. HEMA DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.

• The interpretations and protocols provided by Hema are not a substitute for professional medical advice, diagnosis, or treatment.
• Always consult a qualified healthcare provider before making any health-related decisions.
• Never disregard professional medical advice or delay seeking it because of something you read on Hema.
• Do not make changes to medications, supplements, diet, or exercise routines based solely on Hema's output without consulting your healthcare provider.

[HEMA LLC] IS NOT LIABLE FOR ANY HEALTH DECISIONS, OUTCOMES, OR CONSEQUENCES RESULTING FROM YOUR USE OF THE SERVICE.

7. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, user interface design, biomarker knowledge bases, and software — are owned by [HEMA LLC] or its licensors and are protected by United States and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

8. User Conduct

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse engineer, decompile, or disassemble any part of the Service
• Enter false or misleading health data with intent to deceive or manipulate outputs
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers connected to the Service
• Use automated means (bots, scrapers) to access the Service without our permission
• Resell, redistribute, or commercially exploit the Service or its outputs

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL [HEMA LLC], ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR HEALTH OUTCOMES, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless [HEMA LLC] and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.
